2013 July – Question 2

While this essay was not that difficult, the stand out oddball issue was the Thirteenth Amendment. The rest of the issues were substantive due process including one’s liberty interest and the right to privacy, procedural due process, and equal protection based on age and gender. It is worthy to note that you were required to go through strict scrutiny, intermediate scrutiny, and rational basis review. Standard issues surfaced on this essay such as the duty of competence, contingency fee agreements, the duty to communicate, fee splitting, referral fee, recommending a lawyer’s services, advertising, and a prohibited contact with a witness. This essay was not terribly difficult.
